Terms & conditions of sale

1. Seller identity

The joypadia.com website (“Joypadia”) is published and operated by the publisher identified in the site's legal notice. 2. Purpose

These terms and conditions of sale (T&Cs) govern the sale of the products offered on the Joypadia website to any customer (“the Customer”). Any order implies full and unreserved acceptance of these T&Cs.

3. Products

Joypadia offers handheld retro gaming consoles, TV game sticks and accessories. Consoles and sticks are delivered ready to use, with an SD card and preloaded OS in the versions that include one. Photographs and descriptions are provided for guidance and bind the seller only on the essential characteristics stated.

4. Use and content

The consoles and sticks are emulation devices. Joypadia does not supply or distribute copyright-protected games: the Customer remains responsible for the lawfulness of any content they add to their device and of its use, in accordance with the law applicable in their country.

5. Prices

Prices are shown in euros (€), all taxes included (VAT not applicable, Art. 293 B of the French General Tax Code). Any shipping fees are specified before the order is confirmed. Joypadia reserves the right to change its prices at any time, the product being invoiced on the basis of the rate in force at the time of the order.

6. Orders

The Customer confirms the order after reviewing its details. The sale is confirmed by sending a confirmation email. Joypadia may refuse or cancel an order for a legitimate reason, in particular in the event of non-payment, suspected fraud, product unavailability or an ongoing dispute with the Customer relating to a previous order. The Customer is then informed and fully refunded any amount already paid.

7. Payment

Payment is made online, securely, at the time of the order. The order is processed only after payment confirmation.

8. Delivery

Orders are prepared within 1 to 3 business days after payment confirmation, then shipped. The estimated delivery time, shown before the order according to the destination country, runs from the date of shipment. Unless otherwise stated, delivery takes place no later than 30 days after the order.

In the event of delay, the Customer may, after formally requiring Joypadia to deliver within a reasonable additional period, terminate the contract and be refunded. Detailed terms are set out in our Shipping Policy.

9. Cancellation and right of withdrawal

Cancellation before shipment. As long as the parcel has not been handed over to the carrier, the Customer may cancel their order free of charge by writing to contact@joypadia.com with their order number; they are fully refunded within 14 days. The tracking number is sent while the order is being prepared: cancellation remains possible as long as the tracking does not show that the carrier has collected the parcel. Once the parcel has been handed over to the carrier, cancellation is no longer possible and the order runs through to delivery.

Right of withdrawal. The Customer has 14 days from receipt of the product to withdraw, without having to give a reason, under the conditions set out in our Returns and Refund Policy. They may exercise this right by any unambiguous statement sent to contact@joypadia.com, or by using the model form below, the use of which is not mandatory. Return shipping costs are borne by the Customer, except for a defective product or an error on the part of Joypadia.

10. Legal warranties

All products benefit from the legal warranty of conformity (2 years, Art. L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Art. 1641 et seq. of the French Civil Code).

11. Liability

Without prejudice to the rights the Customer holds as a consumer, in particular under the legal warranties, Joypadia cannot be held liable for damage resulting from improper use of the products or failure to follow the instructions provided. Opening the case, removing the battery or a component, modifying the supplied system (hardware or software) and using a charger or cable that does not match the instructions are in particular non-compliant use. In case of a fault, the Customer is invited to contact Joypadia before any intervention on the device, attaching a photo or a short video; damage directly caused by an intervention of the Customer is not covered, without prejudice to the legal warranties where the defect existed before that intervention and is independent of it. The products are intended for personal and recreational use.

12. Personal data

The Customer's data is processed in accordance with our Privacy Policy and the GDPR.

13. Intellectual property

All elements of the Joypadia website are protected under intellectual property law and may not be reproduced without prior authorization.

14. Governing law and disputes

These T&Cs are governed by French law. In the event of a dispute, the Customer may use a consumer mediator free of charge. Failing an amicable resolution, the French courts have jurisdiction.
